Terms & Conditions

These Terms and Conditions ("Terms") govern your relationship with the operator of the Betano-branded online gaming services made available in Canada via the domain betanogame-ca.com, as referenced in this Betano environment (collectively, the "Services"). By accessing or using the Services you agree to be bound by these Terms. If you do not agree, you must not use the Services. These Terms are effective as of 1 January 2026 and apply in addition to, and do not replace, any official terms and conditions published on https://betanogame-ca.com. In the event of any inconsistency, the official terms on betanogame-ca.com prevail.

Definitions

For the purposes of these Terms, unless the context requires otherwise:

  • Operator means, as applicable:
    • Kaizen Gaming Canada Inc., a company registered in Ontario, Canada and registered as an internet gaming operator with the Alcohol and Gaming Commission of Ontario ("AGCO") under registration number OPIG1242502, operating in conjunction with iGaming Ontario for players located in Ontario; and
    • Kaizen Gaming International Ltd, a company licensed by the Malta Gaming Authority ("MGA") under licence number MGA/CRP/152/2007, involved in providing remote gaming services for markets outside Ontario, including certain rest-of-world operations.
  • Betano refers in this document to the Betano-branded Services as made available to Users in Canada through betanogame-ca.com for review and informational purposes.
  • Website means https://betanogame-ca.com and any subdomains or digital applications through which the Services are offered to Users in Canada.
  • User or Player means any natural person who accesses the Website and/or opens and uses a Player Account to participate in internet gaming offered by the Operator.
  • Player Account or Account means the personal, non-transferable account created by a User on the Website for the purpose of participating in the Services and holding funds.
  • Bet or Wager means any amount of real money or bonus funds staked by a Player on a game, sporting event, or other outcome offered on the Website.
  • Bonus means any promotional credit, free bet, free spins, cash-back, or similar incentive granted by the Operator subject to specific terms and wagering requirements.
  • Wagering Requirement means the total amount that must be staked using Bonus funds or associated deposits before such Bonus or related winnings may become withdrawable.
  • Grey-market activity refers to the availability of services based on offshore licensing in jurisdictions where local regulatory frameworks may not expressly authorize or prohibit such operations. Nothing in these Terms should be interpreted as legal advice regarding the permissibility of participation by Users in any province or territory.
  • Applicable Law means the laws, regulations, and regulatory requirements in force in the province or territory in which the User is located, and any federal laws of Canada, together with the rules of the relevant gaming regulator (including AGCO and iGaming Ontario, where applicable), and where relevant the laws of Malta.

Account Registration

Eligibility and Age Requirements

  • Legal age: You may only create and use a Player Account if you:
    • are at least 18 years old, and
    • are at least the minimum legal gambling age in your province or territory (for example, 19 years in Ontario and certain other provinces).
    You must not use the Services if you are under the legal gambling age in your place of residence. The Operator may request proof of age at any time and suspend or close Accounts where age cannot be verified.
  • Location: Access to the Services may be restricted or prohibited in certain provinces or territories. It is your responsibility to ensure that using the Services is lawful where you are located. Ontario players are subject to the Ontario iGaming framework administered by AGCO and iGaming Ontario.

Account Creation Process

  • Registration: To open a Player Account you must complete the registration form on the Website, providing at minimum:
    • your full legal name;
    • date of birth;
    • residential address;
    • email address and, where requested, mobile phone number; and
    • any other information required by Applicable Law or the Operator's policies.
  • Email and device verification: You may be required to:
    • verify your email address via a confirmation link;
    • verify your phone number via SMS or similar one-time code; and/or
    • verify your device or geolocation to confirm your presence in a permitted jurisdiction.
  • Know Your Customer ("KYC") checks: Before allowing deposits, withdrawals, or continued play, the Operator may require you to submit identification and verification documents, which may include:
    • government-issued photo ID (passport, driver's licence, or other ID acceptable under Applicable Law);
    • proof of address (utility bill, bank statement, or official letter not older than a period specified on the Website);
    • source-of-funds or source-of-wealth documentation where required to comply with anti-money laundering ("AML") and counter-terrorist financing ("CTF") obligations.
    Failure to provide satisfactory documents may result in temporary suspension, limitations on your Account, or closure.

User Obligations

  • Accuracy of data: You warrant that all information you provide is true, complete, and up to date. You must promptly update your details on the Website if any information changes. The Operator may rely on the latest information registered in your Account.
  • One account only: You may hold only one Player Account with the Operator for the Canadian market. Multiple or duplicate accounts may be closed, with Bonuses cancelled and balances handled in accordance with Applicable Law and the Operator's policies.
  • Password and security: You are responsible for keeping your login credentials confidential. You must:
    • choose a strong password;
    • not share your credentials with any third party;
    • log out after each session, especially on shared devices; and
    • immediately notify the Operator via the Website if you suspect unauthorized access.
    Any activity carried out using your credentials will, until you notify the Operator, be presumed to have been performed by you.
  • Use for personal entertainment only: Your Account is for your personal, non-commercial use. You must not use the Account on behalf of any other person, pool funds with others, or act as an agent or intermediary.

Betting & Gameplay Rules

Placing Bets and Wagers

  • Offer and acceptance: A Bet is deemed placed when it is accepted by the Operator's servers and appears in your betting history. Display of odds or game outcomes on your device does not guarantee acceptance if technical or connectivity issues occur before confirmation.
  • Minimum and maximum stakes: Each game or betting market may specify minimum and maximum stake limits. These may vary per event, market, or Player and may be adjusted by the Operator without prior individual notice, subject to Applicable Law.
  • Types of bets: The Website may offer, subject to jurisdictional rules:
    • sports bets (single, accumulator, system, live/in-play);
    • casino games (slots, table games, live dealer games); and
    • other products as displayed on the Website from time to time.
    Availability of any game or market may differ between Ontario and other parts of Canada.
  • Odds and game rules: Rules for specific games and betting markets (including settlement rules, special conditions, and payout structures) are set out in the "Help", "Rules", or game information sections of the Website. By placing a Bet you acknowledge and agree to those specific rules.

Cancellation and Modification of Bets

  • Player-initiated changes: Once a Bet has been accepted and confirmed, you generally cannot cancel or modify it. Any limited features that allow cash-out or partial cash-out are subject to availability and the rules published on the Website.
  • Operator corrections: The Operator may declare a Bet void or adjust settlement if:
    • the Bet was accepted at manifestly incorrect odds or with an obvious error in pricing or event details;
    • the relevant event was cancelled, postponed, or settled under conditions not contemplated in the market rules; or
    • fraud, collusion, or other prohibited behaviour is suspected.
    In such cases, the Operator may void the Bet (returning the stake) or settle it in accordance with the applicable game or sports rules.

Conduct in Games, Live Casino, and Chats

  • Prohibited conduct: When using any chat function, live dealer tables, or interactive features, you must not:
    • insult, harass, threaten, or otherwise abuse other Players, dealers, or staff;
    • use racist, sexist, hateful, defamatory, or obscene language;
    • promote illegal activities, discrimination, or violence; or
    • advertise or solicit products, services, or other gambling websites.
  • Fraud and collusion: You must not:
    • use any automated software ("bots"), scripts, or devices to manipulate play;
    • collude with other Players, including sharing hole-card information or coordinating betting strategies in order to gain an unfair advantage; or
    • exploit software bugs, errors, or malfunctions.
    The Operator may cancel bets, confiscate winnings, and suspend or close Accounts where fraud, collusion, or abuse is reasonably suspected, in accordance with Applicable Law.
  • Responsible gambling: You should only gamble with funds you can afford to lose and make use of the responsible gambling tools provided on the Website (such as deposit limits, loss limits, time-outs, and self-exclusion), which may differ between Ontario and other provinces due to regulatory requirements.

Bonus Terms

Bonus Activation and Eligibility

  • Offer-specific conditions: Each Bonus or promotion offered on betanogame-ca.com is subject to its own terms, including eligibility criteria, maximum bonus amounts, and validity periods. You must carefully read the specific promotional terms before participating. If promotional terms conflict with these general Terms, the promotional terms will typically prevail for that promotion.
  • Eligibility: Bonuses may be limited to:
    • newly registered Players (welcome offers);
    • Players who meet specified deposit or wagering thresholds; or
    • Players located in particular provinces or jurisdictions.
    The Operator may exclude certain Accounts from promotions where required by law or where bonus abuse is suspected.
  • Activation: Bonuses may be credited automatically upon meeting qualifying criteria (e.g., minimum first deposit) or may require manual opt-in by entering a bonus code or selecting the promotion in the cashier prior to depositing or placing a Bet.

Wagering Requirements and Timeframes

  • Wagering requirements: Unless stated otherwise, Bonus funds and associated winnings are subject to wagering requirements before they become withdrawable. For example, a bonus with a 10x wagering requirement on bonus plus deposit would require you to wager ten times the combined total of your deposit and bonus amount.
  • Contribution of games: Different games may contribute differently toward wagering requirements. Typically:
    • most slots may contribute 100%;
    • table games and live casino products may contribute at a reduced percentage or not at all; and
    • certain games may be excluded entirely from wagering.

Prohibited Actions and Bonus Abuse

  • Prohibited play patterns: The Operator may consider the following (among others) as bonus abuse:
    • placing large bets that substantially increase your balance and then significantly reducing bet size to meet wagering requirements;
    • hedging Bets across different outcomes to guarantee profit irrespective of result;
    • using multiple Accounts or acting in collusion to obtain multiple Bonuses; or
    • deliberately delaying finishing a game round or free spins to use them later after wagering other funds.
  • Consequences: In cases of suspected bonus abuse or breach of promotional terms, the Operator may, in compliance with Applicable Law:
    • withhold or cancel Bonuses;
    • void or adjust associated winnings; and/or
    • restrict, suspend, or close the Player Account.
  • Combining promotions: Unless expressly allowed in the specific promotional terms, Bonuses may not be combined. You may have to complete the wagering requirements of one Bonus before activating another. The Operator may limit the number of concurrent active Bonuses available to a Player.

Payments & Withdrawals

Deposits

  • Payment methods: The Website may make available, subject to Applicable Law and technical integration:
    • credit and debit cards issued by recognized financial institutions;
    • interac and direct online banking solutions;
    • e-wallets and payment service providers;
    • prepaid vouchers; and
    • where expressly permitted by law and by the Operator, digital or crypto-based payment methods.
    The actual methods available to you are those displayed in the cashier section of your Account and may differ by province or territory.
  • Funding your Account: Deposits are credited to your Account balance once confirmed by the payment provider and the Operator's systems. The Operator does not guarantee that any deposit will be successfully processed and may refuse or reverse deposits where required to comply with AML/CTF or other regulatory obligations.
  • Limits and fees: The Operator may impose minimum and maximum deposit limits per transaction, per day, or per other period. Withdrawals

Any Operator-imposed withdrawal fees, if applicable, will be disclosed prior to confirmation of your withdrawal request. External banking or payment provider fees may apply and are your responsibility.

Refunds, Chargebacks, and Treatment of Bets and Bonuses

  • Refunds of deposits: Deposits made into your Account are intended for gaming purposes. Refunds of unused deposit amounts may be granted at the Operator's discretion and in accordance with Applicable Law and AML/CTF obligations. The Operator is not obligated to refund deposits that have already been used for wagering.
  • Chargebacks: If a chargeback or reversal is initiated on a payment previously credited to your Account, the Operator may:
    • deduct the disputed amount from your Account balance;
    • void Bets or Bonuses funded by the disputed amount; and
    • suspend or close your Account pending investigation.
  • Refunding Bets: In cases where Bets are voided due to event cancellation, manifest error, or technical failure (as determined in accordance with the game or sports rules and Applicable Law), the Operator will generally return the stake to your Account.
  • Bonuses on withdrawals: If you request a withdrawal before completing the wagering requirements associated with a Bonus, that Bonus and any associated winnings may be forfeited, as detailed in the specific promotional terms.

Limitation of Liability

Operator's Obligations

  • Fairness and regulatory compliance: For Ontario-based Players, the Operator is registered as an internet gaming operator with the AGCO under registration number OPIG1242502 and operates under agreement with iGaming Ontario. For other markets, operations may rely on the MGA licence of Kaizen Gaming International Ltd. The Operator uses approved game providers and takes reasonable measures to ensure that games are fair and operate as intended.
  • Accuracy of information: The Operator endeavours to ensure that information on the Website (including odds, game rules, and results) is accurate and up to date. However, occasional errors or omissions may occur. Where such errors materially affect a Bet or game, the Operator may correct, void, or re-settle Bets in accordance with these Terms and applicable rules.
  • Service availability: The Operator aims to provide the Services on a continuous basis but does not guarantee uninterrupted or error-free operation. Scheduled maintenance, security updates, or unforeseen technical issues may temporarily affect availability.

Exclusions of Liability

  • Technical failures: To the maximum extent permitted by Applicable Law, the Operator is not liable for:
    • interruptions, delays, or failures in communication or connectivity, whether caused by your equipment, your internet service provider, or third-party networks;
    • software bugs, viruses, or malfunctions not directly caused by the Operator's gross negligence or wilful misconduct; or
    • loss, corruption, or delay of data transmission outside the Operator's reasonable control.
  • Indirect and consequential loss: To the maximum extent permitted by Applicable Law, the Operator is not liable for any:
    • loss of profits, business, revenue, or opportunities;
    • loss of data, goodwill, or reputation; or
    • indirect, incidental, punitive, or consequential damages,
    arising out of or in connection with your use of the Services, even if the Operator has been advised of the possibility of such damages.
  • Third-party websites and content: The Website may contain links to third-party sites (including regulatory bodies such as AGCO, iGaming Ontario, or MGA, and industry publications referencing awards such as the 2022 "Operator of the Year" by EGR). These links are provided for information only, and the Operator is not responsible for their content or for any loss or damage arising from your use of them.

Maximum Compensation

  • Cap on liability: Without limiting any non-excludable rights you may have under Applicable Law, and except in cases of death or personal injury caused by the Operator's negligence, fraud, or other liability that cannot be limited by law, the Operator's total aggregate liability to you arising out of or in connection with any single Bet, game round, or related transaction shall not exceed the greater of:
    • the amount you staked in that particular Bet or game round; or
    • the amount actually lost by you as a direct result of the Operator's proven breach of these Terms, up to a maximum set by Applicable Law.
  • Legal rights preserved: Nothing in these Terms excludes or limits any statutory rights that you may have under consumer protection or gaming legislation in Canada which cannot legally be excluded or limited.

Intellectual Property Rights

Ownership of Content and Software

  • Proprietary materials: All content on the Website, including but not limited to text, graphics, logos, trademarks, trade names, icons, images, audio-visual material, software, and source code, is owned by the Operator or its licensors and is protected by copyright, trademark, and other intellectual property laws.
  • Licensed technology: The Operator may use third-party game software and platforms under licence. Your use of such software is limited to accessing and playing the games through the Website in accordance with these Terms and any applicable end-user licence terms.

Restrictions on Use

  • No unauthorized copying or distribution: You may not, without the prior written consent of the Operator or the relevant rights holder:
    • copy, reproduce, modify, adapt, translate, or create derivative works from any part of the Website or its content;
    • distribute, transmit, publicly display, publicly perform, or otherwise make available the Website or its content;
    • reverse engineer, decompile, disassemble, or attempt to derive the source code of any software used in connection with the Services, except where such activities are expressly permitted by Applicable Law and then only to the extent of that permission.
  • Permitted personal use: The Operator grants you a limited, revocable, non-exclusive, non-transferable licence to access and use the Website for your personal, non-commercial entertainment on devices that you own or control, strictly in accordance with these Terms and Applicable Law.

Privacy & Data Protection

  • Privacy policy: Your personal data is collected, used, stored, and otherwise processed in accordance with the Operator's privacy policy as published from time to time on https://betanogame-ca.com. By using the Services, you acknowledge that you have read and understood the applicable privacy policy.
  • Regulatory and legal requirements: The Operator processes your personal data to:
    • provide and manage your Player Account and the Services;
    • comply with AML/CTF, KYC, and responsible gambling requirements set by regulators such as AGCO and iGaming Ontario, and by the MGA where relevant; and
    • detect and prevent fraud, money laundering, and other prohibited activities.
  • Data subject rights: Subject to Applicable Law, you may have rights to access, rectify, delete, or restrict processing of your personal data. The privacy policy explains how to exercise these rights and how to contact the Operator regarding privacy matters.

Changes to Terms

  • Right to amend: The Operator may amend these Terms from time to time to reflect changes in law, regulatory requirements, technical or security developments, or adjustments to business practices. Updated Terms will be made available on the Website and will indicate the date on which they become effective.
  • Notification: Where required by Applicable Law or regulatory guidance, and where reasonably practicable, the Operator will notify you of material changes by appropriate means, which may include:
    • displaying a prominent notice or banner on the Website;

    • presenting the revised Terms for acceptance upon your next login.

Termination & Suspension

Operator's Rights

  • Suspension and closure: The Operator may suspend or close your Account, restrict your access to the Services, or withhold funds where it reasonably believes that:
    • you have breached these Terms or any game or promotional rules;
    • you are underage, have provided false or misleading information, or have failed verification checks;
    • you have engaged in fraud, money laundering, collusion, or other unlawful or prohibited activities; or
    • such action is required by a regulator, law enforcement agency, court order, or Applicable Law.
  • Regulatory requirements: In Ontario, the Operator's actions are subject to the requirements and directions of AGCO and iGaming Ontario, including any obligations to suspend or close Accounts or to enforce self-exclusion and other responsible gambling measures.

Player-Initiated Closure

  • Voluntary account closure: You may close your Account at any time by using the relevant option on the Website (if available) or by contacting customer support via the channels indicated in the "Contact Information" section. Closure will not affect obligations or rights that have already arisen.
  • Self-exclusion and responsible gambling: If you wish to restrict or permanently cease gambling, you may request self-exclusion in line with the responsible gambling tools and regulatory frameworks provided on the Website. For Ontario, this may include connection to province-wide exclusion programs as required by AGCO and iGaming Ontario.

Effect of Termination

  • Balances and outstanding Bets: Upon closure of your Account, any real money balance (excluding Bonus funds and funds subject to investigation or legal restriction) will ordinarily be returned to you, subject to:
    • completion of any outstanding verification checks; and
    • compliance with AML/CTF and other legal obligations.
  • Bonuses and promotions: Upon termination or self-exclusion, outstanding Bonuses and any associated unmet wagering requirements may be cancelled, in accordance with the promotional terms and Applicable Law.
  • Survival of provisions: Provisions relating to limitation of liability, intellectual property, governing law, jurisdiction, and any other terms that by their nature should survive termination shall continue to apply after your Account is closed.

Governing Law & Jurisdiction

Ontario Players

  • Applicable law: For Users located in the Province of Ontario who access the Services offered under the registration of Kaizen Gaming Canada Inc. (OPIG1242502) and the iGaming Ontario operating agreement, these Terms and your relationship with the Operator are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, subject to any mandatory provisions of law in your place of residence.
  • Regulatory oversight: The Services for Ontario Players are subject to oversight by AGCO and iGaming Ontario. Any rights or remedies provided under the regulatory framework or under AGCO/iGaming Ontario policies are in addition to the rights set out in these Terms.
  • Dispute resolution: If you have a complaint, you should first contact the Operator's customer support using the channels indicated on the Website. If you remain dissatisfied, you may escalate the complaint internally in accordance with the Operator's complaints procedure, and, where applicable, you may have the right to bring the matter to the attention of iGaming Ontario or AGCO in accordance with the procedures published on their official websites. Nothing in these Terms restricts your right to initiate legal proceedings before the courts of Ontario where permitted by law.

Players in the Rest of Canada

  • Legal considerations: For Users located outside Ontario, access to and use of the Services may rely on licensing held by Kaizen Gaming International Ltd under MGA licence MGA/CRP/152/2007. Regulatory frameworks and enforcement practices differ among Canadian provinces and territories. Participation in offshore-licensed gambling services may carry legal and tax implications, and you are responsible for ensuring that your participation is lawful in your jurisdiction. These Terms are not legal advice.
  • Applicable law and forum: Subject to any mandatory laws in your province or territory of residence, and unless otherwise required by Applicable Law, your use of the Services outside Ontario and any disputes arising therefrom may, at the Operator's election and to the extent permitted by law, be governed by:
    • the laws of the relevant Canadian province or territory in which you reside, and/or
    • the laws of Malta, in line with the MGA licensing framework.
    The competent courts or dispute bodies will be determined in accordance with those laws and any applicable consumer protection rules.
  • Alternative dispute resolution: Where available under Applicable Law or regulator guidance, you may have the right to use independent dispute resolution or mediation schemes. Details, if applicable, are ordinarily provided in the Operator's official terms on betanogame-ca.com.
